Junbish Party Draft Statute

 

This statute is drafted in 9 chapters and forty seven articles

 

Chapter # 1:  conditions of membership

 

Article 1: 

 each citizen of Afghanistan (male or female) who has completed 18 years old can accept the statute of the party, pay membership fee and become member of Junbish Milli Islamy Afghanistan (JMIA)

One looking for membership should have good reputation among people.

Junbish Individual Membership Acceptance will be done by its local councils.

Political parties, organizations and entities as a whole can also gain membership of Junbish by bilateral agreements.

The individual and group Junbish Membership Acceptance will be determined by Central Council code of conduct.

Member of Junbish can not have membership of any other political parties at the same time

 

Article 2:

 

Membership ID cards will be distributed to Junbish members. The issuance, distribution, receipt and tenure of membership ID card will be determined by Central Council code of conduct. 

If and when, a member of Junbish is assigned to a governmental position, which requires that he or she legally should not political party affiliation, they are to inform Junbish council of the issue. Junbish council will suspend their membership during the time they occupy the position and their membership ID card will be temporarily kept at the respective council.

 

 

 Chapter # 2:  Rights and duties of members

 

Article 3:

Each member of Junbish has the right to:

-        To participate as constituent or candidate in the elections for leadership positions and to campaign in a democratic way for party offices.

-        Ask the relevant council for information on how the Party Yearly Budget is realized

-        Give his or her proposals, opinions and suggestions in regards with implementation of party general and ongoing policies and activities of party authorities in the party belonging meetings and medias

-        To be added, according to the Central Council implemented rules, to the list of candidates for central and local party positions in the elections.

-        To receive both material and political support from party side during his/her election campaign

 

Article 4:    

 

Each member of Junbish has the following duties:

 

-        To be well familiar with programs, statute and ongoing policies of the party and to extend his/her perseverance and initiative to realize them.

-        To pay membership fee and to financially support Junbish based on his/her capability.

-        To accept consensus and decisions of party authorities and implement them.

-        To have active participation in the election campaigns and support party candidates.

-        To extend his/her constant effort for maintaining party discipline and strength of unity

-        To increase Junbish reputation among people by his/her pleasant speeches and manner

-        To defend from democracy, social justice, national and community values and to extend his/her best effort strengthening real national unity.

 

Chapter # 3:  Central Administration/leadership  

 

Article 5:

 

-        The highest leadership rank of Junbish is its general convention which is held every two years. Especial party convention can also be held according to the request of one third of Central Council members and accepted/approved by two third of them

-        According to Central Council code of conduct, members of general convention are elected from cities and districts of each province based on democratic principles and proportionate to quantity of Junbish members

 

Article 6:

 

General convention has the following duties and mandates/authorities:

 

-        To listen and evaluate reports of Central Council in regards to situation in the country and activities of party during the period of time between two conventions

-        To listen and evaluate report of Central Inspection and Supervision Commission regarding Party discipline status and party budget realization during the period between two conventions.

-        To determine general and ongoing policies of the party as well as its policy in the presidential and parliamentarian elections.

-        To bring any changes or amendments in the statute, flag and logo of the party

-        To elect the head of Central Council

-        To elect members of Central Council

-        To elect members of Central Inspection and Supervision Commission

-        To approve sample of Junbish flag, logo and membership ID

 

Article 7:

 

-        Junbish Central Council has 105 members who are elected for two years by general convention

-        Voting for members of Central Council can be either secret or open according to the decision of general convention

-        If and when the number of female winners is less than 10 percent in the list of winners, the female candidates who have the highest number of votes shall be added to the list of winners so that there is at least 10 percent female in the list of winners.

 

Article 8:

 

-        Central Council meeting is help every six months and its especial meeting can be held according to the request of one third of its members and approval of political committee

-        Central Council in its first meeting will elect political committee, first deputy and deputies of Central Council who will be at the same time members of political committee through secret and direct vote

-        Central Council Meeting is held only when at least more than half of its members are present and its decisions are considered official only when approved by two third of its members.

 

Article 9:

 

Central Council has the following duties and authorities:

a-      To take decision on implementation of statute and resolutions of general convention

b-     To achieve increase of supporters and its good impact among people so that majority of them support the party candidates during elections (according to constitution law)

c-      Regular evaluation and analysis of political situation in the country and determining party’s policies toward major political development

d-     To appoint the time and place for holding party general convention and providing its agenda

e-      To take decision on acceptance of new members to Central Council

f-       To take decision on sacking offender members (regardless of their position) from Central Council according to suggestion of Central Inspection and Supervision Commission and approval of political committee.

g-      To approve Central and provincial structures and to bring any changes, addition or deduction when necessary it them

h-      To provide reports about activities of the party  to candidates at general convention during the period between two conventions

i-        To determine methods for awarding cadres, activists, members and unique sympathizers of Junbish according to especial code of conduct 

 

Article 10:

 

-        Head of Central Council is elected through secret and direct vote of general convention members for two years and no one can be nominated after two continuous years unless he/she has a two year interval after the second year.

 

Article 11:

 

Nominated person for the position of Head of Central Council should have the following qualifications:

-        To be citizen of Afghanistan and follower of Islam holy religion

-        To have completed thirty years old

-        To have been member of Junbish for five years and to be member of general convention.

-        To have not been deprived from civil rights by court

-        At least 50 members of general convention from ten provinces of the country accept/approve his/her nomination in written.

 

Article 12:

-        Among the nominated candidates for Head of Central Council position, the person who gets more than 50 percent votes of general convention members will be considered as elected. When ever no candidate can get the majority of votes in the first round, two of the candidates who have the highest number of votes will go for the second round of elections and who ever gets the majority will be considered as elected

 

Article 13:

 

Head of Central Council who will be at the same time member of political committee will be responsible for Central Council and will have the following duties and authorities:

-        will chair Central Council, Political Committee and Junbish Secretariat meetings

-        To be allegory of Central Council and its dignity in internal and external societies

-        To keep eyes on implementation of Junbish budget

-        To sign resolutions, documents and statements on behalf of party

-        To council with originator of Junbish regarding important national issues and political policies of Junbish

 

Article 14:

 

Central Inspection and Supervision Commission has 51 members who are elected by general convention for two years.

Election of Central Inspection and Supervision Commission members will be done according to descriptions of paragraph 7 of this statute.

Central Inspection and Supervision Commission in its first meeting will elect a jury including one head and five inspectors for the regions

 

Article 15:

 

Duties and authorities/mandates of the jury are as follows:

 

a-      to monitor the party authorities implement the statute

b-     to monitor the process of spending party budget by provincial and central councils

c-      to monitor the transparency and openness of inner party elections at all levels

d-     to investigate the received complaints from party councils in regards to moral and statute norms violation by party leading authorities

e-      to suggest divest their membership as penalty in case the assertions regarding political committee and Central council members’ violation confirmed  

f-       The following types of party penalties can be imparted to party authorities by Central Inspection and Supervision Commission Jury.

-        recommend

-        warning

-        written warning

-        The jury will take decision to sack the violated members from leading positions of the party by votes of two third, in other cases with the votes of majority, of its members

 

Article 16:

 

Political committee of the party is the second rank after central council and has equal responsibility. Political committee has 17 members and they hold meeting at least once a month

Candidates for political committee should have the following qualifications:

-        to be citizen of Afghanistan

-        to have completed 25 years old

-        to have not been deprived from civil rights by court

-        to have gained membership of Junbish central council

 

Article 17:

 

 The duties and authorities of the political committee are as follows:

1-     to approve working plan for central council and to appoint time and place of its meetings

2-     to assign senior members of Central and provincial councils

3-     to approve and or amend the party budget and to monitor its implementation

4-     to take decision on establishing new offices for central and provincial councils

5-     to establish and politically administer the party publications

6-     to investigate Central Inspection and Supervision Commission Suggestion on divesting violated members from party leading organs as penalty and referring it to central council

7-     to approve the list of party candidates for parliamentarian elections and for chairs (head position) at provincial, district and municipality councils

8-     to assign the spokesperson of central council for national and international affairs

9-     To approve the agreements and concluded protocols between Junbish and other political parties.

10-  To approve the secretariat code of conduct and as well as term of reference/job description for central council offices/units

 

Article 18:

 

Political committee will establish the following units/offices in the Central Council frame:

 

-        Personnel

-        Culture, knowledge and publications

-        Election Affairs

-        Training and Supporting rights

-        Filing and financial affairs

-        Youth affairs

-        Religious affairs

Each of the central units/offices will be supervised by one of Central Council deputies

 

Article 19:

 

Central Council Secretariat (CCS) is consisted of one head, first deputy and deputies of central council. CCS will supervise the daily activities of central council offices/units and provincial councils and will report to political committee

 

Article 20: 

 

CCS also has the following responsibilities:

-        To monitor the implementation of general convention and party central council resolutions and consensuses

-        To monitor party wealth and to increase its revenue

-        To organize registration and statistics of Junbish members and to distribute membership ID cards

-        To continue negotiations with parties and political entities and contract protocols with them

-        To adopt a position for party in relation to national and international issues and to publish them

-        To take decision on staging protest and political scenarios according to the implemented laws of the country.

-        To establish constant contact with party group at the parliament and to politically direct them

  

Chapter # 4: Junbish local Organizations

 

Article 21:

 

The structure of Junbish local organizations is fixed according to civil administration and electoral units (based on elections rules)

The main unit of local organizations is the provincial organization.   

 

Article 22:

 

Junbish Provincial Commission is (JPC)the highest party decision making rank in the province which is consisted of elected members of party district and city conferences, and holds its meetings once a year.

 

Article 23:

 

The authorities of JPC are as follows:

-        To listen to and evaluate the Junbish provincial council activity report

-        To elect JPC members

-        To take decision on the list of party candidates for provincial council elections for approval of the secretariat.

-        To take decision on the list of party candidates for parliamentarian elections

-        Nomination/introduction of candidates for approval by secretariat and their participation in provincial council (government), and municipality elections

 

Article 24:

 

-        JPC which is consisted of elected members of district and city conferences, during the period between provincial conferences, is the Junbish leading organ in the province. It implements the resolutions and consensuses of Junbish high ranks in the province.

-        JPC in its first meeting will elect its head, deputies and executive delegation for one year and will establish necessary offices.

-         The final approval for establishment of provincial offices and their operation budget remains to political committee of Central Council

 

Article 25:

 

-        According to overall principles, JPC is free to decision making for raised issues in the province and will report from its activities to Central Council.

 

Article 26:

 

-        For better administration and organizing party affairs and for coordination among two or more of Junbish Provincial Councils, Central Council can establish regional offices according to its budget.

 

Article 27:

 

-        The highest party rank in the districts and cities is the district and city conferences which are consisted of elected representatives of primary units for the relevant district or city. The party city and district conferences hold meetings every year and have the following authorities.   

a-      To listen to and evaluate the relevant district or city council report

b-     To provide list of candidates for district and municipality council elections for approval of provincial council

c-       To suggest candidates to be included in the list of party candidates for parliamentarian elections.

 

Article 28:

 

Junbish city and district councils:

-        Implements the decisions of central and provincial ranks in the relevant district or city

-        Establishes Junbish primary units and supervises their activities.

-        Directs and helps the party group in the city and district councils

 

Chapter # 5

 

Article 29:

 

The main cell of Junbish body is its primary units which get formed by at least five members of Junbish in a village, alley, residential blocks, hostels, and other living areas.

 

Primary units can also be formed in the working environments as well in case where the activities of political entities are not legally prevented.

 

Article 30:

 

Primary Units (PU) in their first meeting will elect two of their members as head and deputy of PU for one year. In case in a PU the number of Junbish members increases 25, proportionate to the number of party members, they will also elect a leading council for their relevant PU and for the same period of time. And incase there are more than 100 Junbish members, the PU can establish Smaller Residential Unit Offices as well as polling centers and polling stations during elections.

 

Article 31:

 

Primary Units are the main chain of connection between Junbish and community and are supervised by party local councils.

The main duties of PU are as follows:

-        Constant and increasing relation with community

-        Constant meetings with representatives of different strata of people, diagnosing their problems, demands and fundamental necessities and to bring the attention of party authorities to work on them.

-         To inform people of party resolutions and consensuses and to gain support of people from them

-        To take part/participate in the public welfare activities, like funerals, weddings, volunteer works, Eids, and national and religious ceremonies

-        To develop the reputation and dignity of the party among people and ask their active and eligible representatives to become member of Junbish.

-        To support party candidates during presidential and parliamentarian elections as well as provincial, district and municipality council elections.

-        Distribution of party publications for people.

 

Chapter # 6: Party budget

 

Article 32:

Junbish budget has two columns, revenue and expenditure. Central Council Secretariat prepares the budget in the beginning of each year and it is ready for implementation, after approval of political committee.

 

Article 33:

 

Junbish revenues are obtained from the following resources:

 

Membership fee: all members pay monthly

Admission fee: new member pay admission fee

Contributions: cash, removable and irremovable assets which are given to Junbish by its members and its sympathizers inside and outside of the country.

Incomes of benefit organizations: according to the current laws of the country party can establish and administer benefit entities

Government aids: government can give donations on demand to the party for running election campaigns according to the law.

 

Article 34:

 

 Junbish expenses cover the followings:

-        paying salaries (permanent staffs of central and local councils) and service expenses (communication, transportation, rents and stationary)

-        Publishing and commercial activity expenses

-        Election campaign expenses

-        Holding general convention and party conferences

-        Unexpected expenses

-        Junbish allocates 10 % of its revenue for martyr families, disables, and other charity affairs to assist them.

 

Article 35:

 

The amount of membership and admission fee will be determined by Central Council resolution.

 

Article 36:

 

Transparency and accountability are main principles of party financial affairs and their violation will be considered as a loss to public benefit and shall be punished

If a member of Junbish gives it a big loss or embezzles its wealth, according to the law Junbish has the right to bring him/her up to justice and claim its property

 

Chapter # 7: Rewarding and punishment

 

Article 37:

In case Junbish members show eligibility and merit in, maintaining relation between party and people, serving the country and in their overall duties they will be awarded in the following ways:

-        Award of local council thank you note

-        Award of Central Council appreciation letter

-        Award of Junbish originator memorial medal

-        Putting their pictures in the party notes boards and website  

 

Article 38:

 

In case Junbish members don’t take active part in party preparations, violate the party statute, violate laws, and oppress the rights of citizens, they will be punished by the party in the following ways:

-        recommend

-        warning

-        written warning

-        sacking from duty

-        sacking from party positions

-        expelling from party membership

 

Chapter # 8: Party Originator

 

Article 39:

 

Honorable General Abdul Rashid Dostum is founder of Junbish Milli Islamy Afghanistan

Junbish considers his great services for development of the country and prosperity of our nation appreciable and persuades the moral of respect to founder of the party among its members.

 

Article 40:

 

Head of Central Council will consult all national important issues as well as important decisions made by party including its way of relation with the government with originator of Junbish

 

Article 41:

 

Founder of Junbish shall have the following concessions as long as alive:

-        installation of his official photo in all offices of the party

-        official inauguration of general convention

-         to make a memorial medal and award it as a reward along with signature of Junbish originator to most active members, cadres and Junbish sympathizers

 

Article 42:

 

According to the implemented laws, Junbish will support physical, political and legal safety of party originator

 

Article 43:

 

Junbish originator should use his ability and reputation to further develop the social and political dignity of Junbish

 

Article 44:

 

Junbish flag has the following descriptions;

 

-        Party flag is made of three pieces which have the same width and respectively black, red and green colors. The length of the flag is twice bigger than its width and has a logo of the party on its left upper half.

 

Article 45:

 

Junbish logo has the following descriptions:

-        In the middle of the logo there is an Afghanistan map, inside the map there is a rostrum and an altar, on both sides of the Afghanistan map there are two swords and on the top of it Islam Faith Words are written and in the bottom of the map there is a mountain peak where from sun is rising. All of the said emblems are surrounded by two wheat clusters. There is a three color ribbon on the lower half of the clusters, underneath there are gearwheels and on the top written Allah Akbar (God is great). On the ribbon written Junbish Milli Islami Afghanistan.

 

Article 46:   

 

Elections Symbol:

The election symbol of the party is a young and healthy horse which is trotting on the green grass and towards blue horizon. This indicates from strong and tireless effort for reaching its goal which is a peaceful, prosperous and superb Afghanistan.

 

During election campaigns Junbish candidates will be denoted and introduced with party symbol

 

Article 47:

 

Junbish Provincial Councils have specific stamps which has the name of the relevant Provincial Council and Junbish logo.
